Terms of Service

1. Who we are and what these terms cover

EnergyOn Sim (the "Service") is a software-as-a-service platform for solar PV, battery and generator savings analysis, operated by EnergyOn South Africa Pty Ltd ("EnergyOn", "we", "us"), a company registered in the Republic of South Africa. These Terms of Service (the "Terms") govern your access to and use of the Service at app.energyon.co.za and related websites. By creating an account or using the Service you agree to these Terms on behalf of yourself and, where applicable, the organisation you represent (together, "you" or the "Customer").

The Service produces engineering and financial estimates — including simulated energy flows, savings, tariffs, payback, IRR and related figures — based on the inputs supplied and stated assumptions. Results depend on data quality, tariff changes, weather, equipment behaviour and other factors outside our control. Outputs are decision-support information, not a guarantee of performance, savings or financial return, and do not constitute financial, tax, legal or engineering advice. You remain responsible for professional review of any design, quote or proposal you present to your customers.

7. Intellectual property

The Service — including its software, simulation engine, interfaces, templates and branding — is and remains the property of EnergyOn and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription in accordance with these Terms. Feedback you give us may be used to improve the Service without obligation.

8. Availability, support and changes

We aim for high availability but the Service is provided "as is" and "as available"; maintenance windows and occasional interruptions are unavoidable. We may improve or modify features over time, and will not materially reduce the core functionality of a paid plan during a paid period without notice. Support is provided via email and in-app channels during South African business hours.

9. Limitation of liability

To the maximum extent permitted by law (including the Consumer Protection Act where it applies): (a) neither party is liable for indirect, consequential, special or punitive damages, or for loss of profits, revenue or data; and (b) EnergyOn's total aggregate liability arising out of or related to the Service in any 12-month period is limited to the fees you paid for the Service in that period (or R1,000 if you are on a free plan). Nothing in these Terms limits liability that cannot lawfully be limited.

10. Suspension and termination

You may stop using the Service or cancel at any time. We may suspend or terminate access for material breach, non-payment after the grace period, or where required by law — with notice where practicable. Sections that by nature survive termination (including 4, 5, 7 and 9) survive.
